Action-over claims

What is an action-over claim?

An employee of a contractor is injured on the operator's site. Workers compensation bars the employee from suing their own employer, so they sue the operator, and the operator turns to the contractor under the indemnity in the master service agreement. Contractual liability coverage and the additional insured endorsement on the contractor's general liability are what respond, which is why both are written to the wording the MSA requires.

What does an operator's MSA require of my insurance?

Typically a set of minimum limits, additional insured status on a specified form, primary and non-contributory wording, a waiver of subrogation, and an indemnity that the Texas and Oklahoma oilfield anti-indemnity statutes may limit or require to be supported by insurance. All of it gets read before you sign, and the program is built to deliver it, so the certificate is written to the operator's wording from the start.
